The illegal search happened as a result of the police receiving an alarm call and proceeding to the wrong address. When his client came to the door the client refused entrance by the police officer who smelled marijuna. The police called for back up and placed his client under arrest. Inside the house the police found 7 marijuna plants ,1.5 pounds of processed marijuana, digital scales and a grinder as well as rolling papers, 4 shotguns, 2 rifles and a stolen Ruger 9mm handgun.
The judge dismissed all charges against Attorney Thomas Overton’s client at a preliminary hearing due to the illegal search of my clients home without a search warrant saving this client from a possible 8-25 sentence.
